General Terms and Conditions of Sale

These general conditions of sale (hereinafter the "GTC") are concluded on the one hand by the Company cecileCparis, a simplified joint-stock company with share capital of 1,000 euros, whose registered office is located in PARIS (75018), 39 Rue de la Chapelle, registered in the PARIS Trade and Companies Register under number 913 373 072, hereinafter referred to as "CECILECPARIS", owner of the website: cecilecparis.com, hereinafter the "Site" and, on the other hand , by any natural or legal person wishing to make a purchase via the cecilecparis.com website, hereinafter referred to as the "Customer" or the "Buyer".

Article 1: object


These general terms and conditions of sale aim to define the contractual relationship between CECILECPARIS and the Customer and the conditions applicable to any purchase made through the cecilecparis.com website.

The acquisition of a product through this Site implies unreserved acceptance by the Customer of these GCS which he acknowledges having read prior to his order. The Customer declares to have read them and to have accepted them without reservation, by ticking the box provided for this purpose before validating the online order.

Before any transaction, the Customer declares to have full legal capacity, allowing him to engage under these GCS.

The products offered on the cecilecparis.com Site are exclusively intended for sale to end consumers who are natural or legal persons, excluding any resellers or intermediaries acting on behalf of resellers. Consequently, the Customer declares to act as an end consumer and that he does not intend to resell, directly or indirectly, these products for commercial purposes, this commitment constitutes an essential condition for CECILECPARIS.

These GCS specify in particular the conditions of ordering, payment, delivery and management of any returns of products ordered by Customers.

These GCS shall prevail over any other condition appearing in any other document, unless there is a prior written derogation.

These GCS may be subject to subsequent modifications, the version applicable to the Customer is that in force on the Website on the date of placing the order.

Article 2. Products


The Products offered are those that appear on the cecilecparis.com Site.

Product offers are valid within the limits of available stocks. Indeed, at the time of validation of the order, there may be a difference between the stock available electronically and the existing physical stock (for example in the event of simultaneous orders for the same product by several Customers). The sale is therefore subject to the availability of the Products in stock. Furthermore, CECILECPARIS reserves ownership of the Products until payment for the Products.

Each Product is presented on the Website in the form of a description containing its main technical characteristics (composition, color, size, dimensions).

The Customer is required to read it before placing an order.

The choice and purchase of a Product is the sole responsibility of the Customer.

The photographs and graphics presented on the Site are not contractual and cannot engage the responsibility of CECILECPARIS.

The date of availability of a pre-ordered Product will be expressly indicated on the product sheet. In the event of a change in the date of availability, you will be immediately informed by email and/or on your Customer account.

In the event of unavailability of a Product after placing your order, we will inform you of this by e-mail or telephone as soon as possible, offering you either to order another Product presented on the Site as a replacement, or to cancel your order.

CECILECPARIS incurs no liability in the event of out of stock or unavailability of the Products.

CECILECPARIS reserves the right to change the Products offered on the Site at any time and without notice.

In order to ensure a better quality of service and availability of our Products for all of its Customers, CECILECPARIS reserves the right to limit the quantity of Products that can be purchased by a Customer, in accordance with the provisions applicable in the subject and in particular those of Article L. 121-11 of the Consumer Code.

The sale of the Products presented by the Cecilecparis.com Site is intended for all buyers residing in countries which fully authorize the entry into their territory of these products.

Article 3. Order Procedure


At any time, you can add Products to your selection by clicking on “Add to basket”. You can consult your selection by clicking on "Basket" in the menu at the top right where will appear: the photo(s) of the Product(s), its colors and reference(s), the quantity(s) chosen, its (their) unit price(s) and the subtotal of the selection.

After selecting the Product(s), click on "Order" to start the ordering process.

A Customer account is required to be able to place an order on the Site:

– If you already have a Customer account, you will need to identify yourself at this stage by entering your password.
– If you do not have an account yet, you will be prompted to create one by confirming your email address and creating a password later.

Your usernames and passwords are strictly personal, therefore you agree to keep them safe and never communicate them to third parties. In the event of loss, theft or any fraudulent use of your Customer account, you undertake to inform CECILECPARIS

Creating an account allows you to :
– track your deliveries and view your order history ;
– return or exchange Products ;
– add or modify your delivery and billing addresses for your future orders ;
– manage your subscriptions to the CECILECPARIS newsletter.

Unless proven otherwise by the Customer, the data recorded by the Site constitutes proof of the nature, content and date of all transactions between CECILECPARIS and its Customers. In the event of a conflict between CECILECPARIS and one of its Customers over a transaction carried out on the Site, the data recorded by CECILECPARIS is considered valid proof of the content of the transaction, unless the Customer provides proof to the contrary.

You can have your account deactivated at any time by sending an e-mail or by clicking on the "Contact us" link.

On the one hand, you must validate your delivery method and on the other hand complete the delivery information necessary for the correct dispatch of your order: country of dispatch, title, first name, surname, telephone, delivery address and any other information. required to process your order.

Once this step is complete, click “Continue”.

You can use your delivery address as the billing address or enter another one. You will then be prompted to select a payment method and enter the relevant information.

At the end of the ordering process described above and after having accepted all of these General Conditions of Sale and the Privacy Policy of the Site, click on the "Pay" button.

To confirm a pre-ordered Product, a personalized Product or any other Product requiring an extended shipping time, you must also authorize CECILECPARIS to save your bank details, until the said product is shipped and for a maximum period of 2 months, for the purpose of debiting your account when your order is dispatched.

You must carefully check the accuracy of your selection before confirming your order. While every effort is made to ensure that the color and pattern of the Products whose photos are displayed on the Site are faithful to the original Products, variations may occur, in particular due to the technical limitations of color rendering on your computer equipment.

CECILECPARIS cannot be held liable for non-substantial errors or inaccuracies in the photographs or graphic representations of the Products appearing on the Site. If you have any questions about the Products, you can contact us.

Once completed, your order is sent to CECILECPARIS for processing. The sales contract will be formed once we have received your order. We will ship your Product subject to the availability of the purchased Product (as provided above) and effective payment for the Product.

CECILECPARIS reserves the right not to accept an order from a Customer with whom it is in dispute for a previous order, or if CECILECPARIS reasonably believes that this Customer has breached these General Conditions or that he has engaged in a fraudulent activity, or for any other legitimate reason.

A summary of your order will then be sent to you by e-mail (“Your CECILECPARIS order”). This summary will include the total amount of the order, information relating to the cost and delivery time, the essential characteristics, the quantity and the price of the Products purchased.

We advise you to keep this summary on an electronic medium.

You will then receive a shipping confirmation email for your order with your electronic invoice attached.

We make every effort to ensure that our communications are sent to you as soon as possible.

We recommend that you check your "Spam" folder if you have not received the dispatch confirmation e-mail.

Pursuant to Article L213-1 of the Consumer Code, when an order is for an amount equal to or greater than 120 Euros, CECILECPARIS retains the writing which establishes the contract concluded between CECILECPARIS and a Customer electronically for a period running from the conclusion of the contract until the date of delivery of the goods and for a period of ten years from this date (in accordance with decree 2005-137 of February 16, 2005). You then have access to this document at any time.

You can also download your electronic invoices in the "Your orders" section of your personal account. A Customer account is automatically created for each order. To access your electronic invoices, you must log in to your account. If you have never logged in before, you can click on the account confirmation email to proceed with the creation of a password or you can create a password directly on the site by clicking on « password forgot ».

Article 4. Price


The prices of the Products are indicated in Euros, all taxes included. Apart from the cases of reimbursement made (i) within the framework of the exercise of the right of withdrawal or for (ii) lack of conformity and hidden defects, CECILECPARIS will not reimburse the VAT applied to purchases made on the Site (even in the case where the Customer, after receipt, reships the Products to a third country).

The Products are invoiced on the basis of the prices displayed on the Site at the time of placing your order, subject to availability.

All orders are payable in Euros and must be paid when placing your order. In the event of the unavailability of certain Products ordered, only the price and transport costs relating to the Products available will be debited.

Article 5. Methods of payment accepted


CECILECPARIS offers the Customer the possibility of ordering and paying for their products in several stages, with 2 payment options to choose from :

– Payment by credit card or bank card : The credit cards and bank cards accepted are: Visa®, MasterCard®, American Express®, Carte Bleue®, JCB®, CUP®. Credit card payments are authenticated and secured using the 3D Secure system. This device is also known as “Verified by Visa®”, “MasterCard® SecureCode” or “American Express SafeKey®”. During payment, the bank requests personal information from the Internet user in order to verify the identity of the cardholder and to validate the transaction.

How to pay with the 3D Secure application of your bank card on the Site?

After validating your bank details (card number, expiry date and cryptogram), a new page will appear on which you will have to enter the personal information requested by your bank.

This information can be :

– a password that you have chosen beforehand ;
– a code sent by SMS,

Once the 3D Secure code has been entered and validated by your bank, your order is finalized. You will then receive a confirmation email.

Article 6. Retention of title


CECILECPARIS retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included. On the other hand, you assume the risks (in particular of loss, theft or deterioration) related to the Products delivered from their delivery to the address indicated when ordering or from their collection in the event of collection in store.

Article 7. Terms of delivery

 

Products purchased on the Site can only be delivered in mainland France including the island of Corsica (excluding Guadeloupe, Martinique, Guyana, Réunion, Mayotte, New Caledonia and the French Southern and Antarctic Lands ), in the Principality of Monaco, in Germany (excluding the island of Heligoland and the territory of Busingen), in Belgium, Luxembourg, the Netherlands (excluding the Netherlands Antilles and Aruba), Spain (excluding the Canary Islands, Ceuta and Melilla), Portugal (excluding the Azores Islands and Madeira), Italy (excluding Livigno, Campione d'Italia and the national waters of Lake Lugano), Ireland, Austria (excluding the municipalities of Jungholz and Mittelberg), the Czech Republic, Finland (excluding the Aland Islands), Denmark (excluding the Greenland and the Faroe Islands), Sweden and Poland (hereinafter the “Delivery Zone”).

It is not possible to place an order for any delivery address located outside this Delivery Zone. For reasons, in particular security, CECILECPARIS will not process any order for which a poste restante, a post office box is provided. Deliveries to forwarding companies are excluded.

The Products are shipped to the delivery address that you indicated during the ordering process.

We reserve the right to request a signature and valid ID upon delivery (e.g. passport or driving license).

The shipping costs applicable to COLISSIMO deliveries are as follows :
-Rate in effect for an order delivered outside in France,
-Rate in effect for an order delivered outside of France,

When ordering, we will inform you of the delivery time which will be confirmed in the confirmation of dispatch of the order. The delivery time indicated below runs from the e-mail of dispatch of your order, this period may be extended in the event of exceptional circumstances.

Any order placed on a non-working day will result in the postponement of said delivery time to the next working day.

CECILECPARIS will do everything possible to respect the delivery times provided below. In the event of an event beyond our control resulting in a delay in delivery, we will inform you as soon as possible. You can either request a new delivery date or cancel your order and receive the refund.

Any modification of the terms of delivery must be made via the application made available or the website of our carrier.

Otherwise, CECILECPARIS cannot be held responsible in the event of non-compliance with the delivery terms provided for below.

CECILECPARIS will not be liable in the event of non-compliance with deadlines (delay in delivery, impossibility of delivery, return of the Products to CECILECPARIS, etc.) resulting from the erroneous and/or incomplete nature of the indications provided by you for the delivery. and/or absence on your part at the time of delivery.

Article 8. Withdrawal

 

You have a legal right of withdrawal that you can exercise under the conditions provided for by articles L221-18 and L221-20 of the Consumer Code, if you meet the conditions laid down by these provisions, without having to justify the reasons and without having to pay penalties. The return costs are your responsibility.

Article 9. Guarantee


The Products sold by CECILECPARIS are subject to the conditions of legal guarantees provided for by articles L217-4 to L217-14 of the Consumer Code as well as by articles 1641 to 1648 of the Civil Code, to the exclusion of all other guarantees.

In the event of non-compliance of a product sold, it may be returned to CECILECPARIS, which will take it back, exchange it or refund it. Article 10. Limitation of liability

 

Under no circumstances can CECILECPARIS be held liable for any damage that does not result from a breach by CECILECPARIS of one of its obligations.

Article 11. Intellectual property

 

The structure, layout, graphic charter, texts, database, logos, images, graphic elements, photos and any other component of this Site are protected by copyright. Any total or partial representation of this site, by any process whatsoever without authorization, is prohibited and would constitute an offence.

Article 12. Personal data

 

The personal information collected for the purposes of distance selling is compulsory, as this information is essential for the processing and delivery of orders and the preparation of invoices. Failure to provide this information will result in the order not being validated. In accordance with the law on "Information Technology and Civil Liberties", the processing of personal information relating to Customers has been declared to the National Commission for Information Technology and Civil Liberties (CNIL).

These General Conditions of Sale are governed and interpreted in accordance with French law. In the event of a dispute relating to the application and/or interpretation of these General Conditions of Sale, you have the possibility of contacting us.

You can also use a conventional mediation procedure or any other alternative dispute resolution procedure. In accordance with order no. 2015-1033 of August 20, 2015 and implementing decree no. 2015-1382 of October 30, 2015, any dispute or so-called consumer dispute, subject to article L612-2 of the Code of consumption, can be the subject of an amicable settlement by mediation with the CMAP – Center for Mediation and Arbitration of Paris.
